1. DEFINITIONS

“Applicant” is defined as any Candidate who has successfully submitted an Application and paid the Application Fee.

“Applicant” is defined as any Candidate who has successfully submitted an Application and paid the Application Fee.

“Application” is defined as a request for participation in the Workshop by a Candidate.

“Application Fee” is defined as the processing fee that must be paid by a Candidate for the submission of an Application.

“Cancellation & Refund Policy” has the meaning included below in paragraph 5.

“Candidate” is defined as any individual who has the intention to submit an Application to the Workshop.

“Festival” is defined as the Aegean Film Festival, Non-Profit Organisation, 79 Athanasiou Karali Street, Papagou Athens 15669, Greece VAT EL997003326 Registered Tax Office: DOY Cholargou.

“Misconduct” is defined as any conduct by a Participant during the Workshop that is detrimental to the orderly and safe operation of the Workshop.

“Participant” is defined as an Applicant who has been selected by the Workshop, has accepted his/her/ participation in the Workshop and who has paid the Participation Fee in full and in a timely fashion.

“Participation Fee” is defined as the fee paid by an Applicant for full participation in the Workshop. The Participation Fee is 2600 EURO and includes: 15 three-hour long consulting sessions, 4 two-hour long seminars, Catering during sessions, Workshop related transportation, Workshop Completion Certificate, Opening dinner in Athens, Theatre tickets for Epidaurus Ancient Theatre, Airport & port transfers, Ferry tickets from Piraeus port (Athens) to Patmos,  3-star accommodation for 6 nights in Patmos, Aegean Festival Pass to all Festival’s screenings, Aegean Film Festival seminars, Filmmakers Cocktail Event, Bonfire Story-Pitching Event, Invitations to festival’s closing party, Discount on restaurants & other affiliated businesses, Return ferry tickets from Patmos to Piraeus port (Athens).

“Producers” is defined as the Festival, the host and organiser of the Workshop, and Aegean Film Lab LTD as the executor of the Workshop.

“Tutor” or “Tutors” is defined as the script consultants employed by the Workshop to provide the Participants with the tutoring services included in the Participation Fee.

“We”, “Us” or “Workshop” is defined as the 2018 Aegean Film Festival Storytelling Workshop and includes the Producers herewith.

“Website” refers to the website maintained by the Festival, available at https://www.aegeanff.com

 

2. APPLICATION PROCESS & APPLICATION  FEE

2.1. A Candidate must submit an Application, via the online form available on the Website.

2.2. The Application Fee of 10.00 EUR must be paid at the time of submitting the Application, in order for the Candidate’s Application to be considered as valid.

2.3. The Workshop reserves the right to accept or decline Applicants as Participants at its sole discretion.

2.4. The application period commences on March 1, 2018 and terminates on June 17th, 2018 (UTC 00:00).

2.5. The Workshop reserves the right to extend the termination date of the application period at its sole discretion.

 

3. WORKSHOP PARTICIPATION

3.1. Participants acknowledge that upon acceptance of a place in the Workshop, We are entitled to do all that We deem necessary, including but not limited to making reservations and other expenses, to plan for the Participants’ participation in the Workshop. Accordingly, the Participants agree that the Cancellation & Refund Policy included below (paragraph 5) is both fair and reasonable.

3.2. The language of the Workshop is English. Participants must have the ability to communicate effectively in English, both verbally and in writing.

3.3. Participants are required to arrange and pay for their transportation to and from Athens, Greece, if they do not reside in Athens. Participants are required to be in Athens by Wednesday July 11, 2018.

3.3.1. Participants that fail to arrive in Athens by Wednesday July 11, 2018, for any reason, are not entitled to any discount or refund, but will be allowed to participate in the Workshop provided they arrive in Athens by Friday July 13, 2018.

3.3.2. Participants that fail to arrive in Athens by end of day Friday July 13, 2018, for any reason, are not entitled to a discount or refund, and may not be allowed to participate in the Workshop. They may, however, be allowed to attend the Aegean Film Festival in Patmos and receive the relevant accommodation, transportation and other relevant Festival services included in the Participation Fee.

3.4. In order to participate in the Workshop, Participants that are not citizens of a member state of the European Union or of the Schengen Area must ensure, in a timely manner, that they have the appropriate permission (i.e. visa) and valid passport to travel to Greece.

 

4. PARTICIPATION FEES & PAYMENT TERMS

4.1. Upon acceptance of an Application and if Applicants are offered a position on the Workshop, an Applicant has seven (7) calendar days to accept the offer via email to the email address [email protected]. Failure to accept the offered position on the Workshop within the above deadline of seven (7) calendar days nullifies the offer and the Workshop reserves the right to offer his/her position on the Workshop to another Applicant.

4.2. Providing that an Applicant has accepted the offer within the alloted time, the Applicant will be required to pay in full the Participation Fee in a timely manner, as specified below.

4.3. The Participation Fee must be paid in full within seven (7) calendar days of acceptance of the offer of a position on the Workshop by the Applicant. Non-payment of Participation Fees by the Applicant within the allotted time nullifies the selection and the Workshop reserves the right offer his/her position on the Workshop to another Applicant. Payment can be done via all major credit/debit cards and/or direct bank transfer. PayPal and any other payment means are not supported.

 

5. CANCELLATION & REFUND POLICY

5.1. We reserve the right to cancel the Workshop at any time up to and including the last day of the Workshop (22nd of July, 2018).

5.2. In case the Workshop is cancelled, due to unforeseen circumstances, on or before July 10, 2018, We will endeavour to give the Participants the option of a place on another future Workshop organised by the Producers, a place on a future edition of the same Workshop, or a full refund of the Participation Fee. In any case, We will indemnify the Participant for any expenses incurred by the Participant, such as travel or accommodation expenses etc. The choice will be the Participant’s and must be communicated via email to the email address [email protected] by July 31, 2018. If a Participant does not communicate his/her choice of option within the above deadline, the Workshop reserves the right to decide on the option to provide to the Participant.

5.3. In case the Workshop is cancelled after its commencement on July 11, 2018, due to delays or damages in transportation means or other services, quarantine, sickness, strikes, war, or warlike conditions, equipment theft, fire, earthquake, flood, death, or serious injury, inclement weather or any other unforeseen circumstances or Acts of God, then the Participants will not be entitled to any refund. However, the Producers will endeavour to take reasonable precautions and to operate the Workshop in such a way as to reduce or avoid such circumstances and ensure the safe and unimpeded operation of the Workshop.

5.4. We reserve the right to alter the dates or timetable, either due to changes in the professional schedule of the Tutors or the Workshop speakers, or due to travel difficulties. Any such changes are beyond the control of the Workshop, however, a Participant has the choice to decide whether to participate under the new circumstances, or whether to receive a full refund for the Participation Fee.

5.5. Participants may cancel his/her participation up to and including June 16, 2018 with a full refund of the Participation Fee. Cancellation by a Participant from June 17, 2018 and onwards does not give the right to a refund.

5.5.1.  As mentioned above in 3.3.1. any Participant that fails to arrive in Athens by Wednesday July 11, 2018, for any reason, is not entitled to a discount or refund, but will be allowed to participate in the Workshop provided he/she arrives in Athens by Friday July 13, 2018.

5.5.2. As mentioned in 3.3.2. any Participant that fails to arrive in Athens by Friday July 13, 2018, for any reason, is not entitled to a discount or refund, and may not be allowed to participate in the Workshop. He/She may, however, be allowed to attend the Aegean Film Festival in Patmos and receive the relevant accommodation, transportation and other relevant Festival services included in the Participation Fee.

 

6. ATTENDANCE AND CONDUCT

 

6.1. Participant expressly agrees to refrain from the following acts of Misconduct during the Workshop, any of which shall be grounds for expulsion from the Workshop without refund and may lead to legal action by the Producers.

6.1.1. Misrepresenting the Participant’s qualifications, educational and professional skills, personal data and other information provided in the Application.

6.1.2. Threatening or intimidating other participants, the Producers, the Tutors, Workshop and Festival staff and guests, Workshop and Festival partners or Workshop and Festival suppliers.

6.1.3. Refusing to execute to the best of their ability the tasks given to them as part of the Workshop and complying with the instructions and guidance provided by the Workshop, the Tutors and Workshop staff.

6.1.4. Engaging in unlawful or reckless behaviour that puts themselves, the Workshop, other participants, the Tutors and Workshop staff at risk of harm.

6.1.5. Wilful or reckless misuse, theft, loss or any kind of damage to the Workshop and Workshop suppliers’ facilities and equipment or the equipment and personal effects of other participants, the Tutors and Workshop staff. In such cases We reserve the right to decide whether the Participant will be expelled or not depending on the circumstances of the incident. Furthermore, the Participant may be required to cover in full the original price of the damaged or lost equipment without delay in the most convenient way for the Workshop and its suppliers.

 

7. LIMITATION OF LIABILITY

7.1.  Participant acknowledges and agrees that the Workshop acts only as an agent and assumes no responsibility or liability in connection with the services of any hotel proprietor, hotel service, ferry operator, private boat hire, car or motorbike rental or for any other person engaged in carrying out the accommodation and transportation arrangements. In the event that it becomes necessary or advisable for the comfort or well-being of the Participants, or for any reason whatsoever, to alter the itinerary or arrangements, to change times and days of Workshop sessions, such alternatives may be made without liability to the Workshop.

7.2. Furthermore, the Workshop accepts no responsibility for the loss or destruction of personal articles and effects, nor the loss of tickets, for personal accidents, injury or death, nor for losses or additional expenses due to delays or damages in transportation or other services, quarantine, sickness, strikes, war, or warlike conditions, weather or any other causes that may arise due to Participant’s practices and actions in the Workshop.

7.3. The Workshop, shall under no circumstances, be liable to any Participant for indirect, consequential, incidental, punitive, or special damages, including but not limited to lost profits, loss of goodwill or reputation, special, indirect or consequential losses, even if it has been apprised of the likelihood of such damages occurring.

 

 

8. COPYRIGHT & GRANTING OF GDPR

8.1. All Workshop material, products and services remain property of the Workshop.

8.2. The Participant hereby grants to the Workshop the following rights:

(a) the right to record the Participant’s image, photograph, likeness, and voice for Marketing reasons of the future workshops.

(b) The irrevocable right to copy, use, perform, display and distribute such recordings of the Participant’s for any legitimate purpose, including but not limited to distribution by means of streaming or other technologies via the Internet, or distribution of audio or video files (e.g. podcasts) for download by the public.

(d) The irrevocable right to combine such recordings of the Participants’ with other images, recordings, or printed matter in the production of motion pictures, television tape, sound recordings, still photography, CD-ROM or any other media.

(e) The right to use the Participants’ image and voice in connection with the marketing, promotion and publicity of the Workshop and the Producers’ services, programs, events, or educational or artistic materials.

8.3. The Participant understands and agrees that he/she will not receive compensation, now or in the future, in connection with the Workshop’s exercise of the rights granted hereunder.

8.4. The Participant hereby assigns to the Workshop any and all copyright he/she may have in the recordings made of him/her hereunder.

8.5. The Workshop will not keep or claim any copyright or intellectual right of the ideas produced during the Workshop by the participants. The ideas produced during the Workshop will remain the sole property of the participants.

 

9. EQUAL RIGHTS

9.1. The Workshop operates an equal opportunities policy. All applicants and participants are assessed as individuals and have equal access to the Workshop. Our selection process seeks to capture the wide diversity of potential creative talent in the industry and encourages applicants with the appropriate talent and ability whatever their background, ethnicity, origin, age, gender, sexual orientation, disability, religious or political beliefs.

9.2. The Workshop wishes to support the development of creative participants, none of which is affected by physical ability. Therefore we support the development of individuals who may be physically challenged by the demands of certain tasks which we find is best accommodated by early notification of potential difficulties. We will always try and take reasonable and justifiable steps to accommodate the difficulties in question, taking into account the Participant’s difficulties, practical capability, impact and potential disruption, cost implications, and other legal considerations. However the very nature of the Workshop may make course accessibility difficult for participants with particular types of disability. Where this occurs we will endeavour to discuss the issue with the Participant in advance and to agree to the satisfaction of both parties, whether a Participant can attend certain aspects of the Workshop where such challenges are reasonably and justifiably surmountable, or to otherwise agree to an alternative solution.

 

10. TRAVEL INSURANCE

We strongly recommend that participants purchase travel insurance and We recommend it be purchased the soonest, upon securing a place in the Workshop. With such insurance the Participant can protect himself / herself against unforeseen circumstances that might prevent his/her attendance. We suggest a plan which offers coverage for medical and dental emergencies, lost baggage, missed connections, and trip cancellation should the Participant or a family member have a medical problem that prevents the Participant from attending. The Workshop is not responsible for cancellations due to medical emergencies or reimbursement of airline tickets or other reservations in the event of a Workshop cancellation.

 

11. DATA PROTECTION

Any personal information submitted to the Workshop through the Application will be processed in accordance with the General Data Protection Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 and any other applicable law. All data will be treated as private and confidential and will not be passed on, shared or sold to any third parties.

 

12. GENERAL

12.1. Workshop details, including but not limited to the services included in the Participation Fee, the specifications, the number of participants, the Tutors, and content of the course as well as the dates of the Workshop are subject to change without notice.

12.2. We reserve the right to modify these Terms & Conditions at any time. Except as otherwise stated herein, any change to these Terms & Conditions is effective immediately. Notice may be given via email, by a posting on the Website or through any other means deemed necessary by the Producers. candidates, applicants and participants agree to check the Website periodically for changes to these Terms & Conditions.

12.3. These Terms & Conditions constitute the entire agreement between the applicants, the participants and the Workshop in connection with the Application, the process of selection participants, the participation in the Workshop by the participants and the use of Workshop and Festival related products and services. If any provision of these Terms & Conditions is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavour to give effect to the parties’ intentions as reflected in the provision and that other provisions remain in full force and effect. In the case of any dispute or conflict, arising from a Participant’s participation or involvement with the Workshop and after all possible ways for resolution of the conflict have been exercised, then the dispute should be addressed to the jurisdiction of the courts of England.

12.4. Participants must cooperate with the Workshop Tutors and staff at all stages of the Workshop and be ready to submit, when requested, any written material such as questionnaires and evaluation reports.

12.5. Failure to comply with the Terms & Conditions above may result in the termination of a Participant’s association with the Workshop. The Workshop reserves the right to review participation at any time.
